Welcome to Lanotec. The terms “we”, “us”, and “our” refer to Lanotec Australia Pty Ltd. We operate this website and online store, including all information, content, features, tools, products and services made available through it (the “Services”). Our store is powered by Shopify, which enables us to offer these Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, outline your rights and responsibilities when using our Services. Please read them carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By accessing, browsing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state or territory, and that you consent to any minor dependents using the Services on devices you own or manage.
To purchase products or access certain functionality, you may be required to provide information including your name, email address, billing details and shipping information. You represent that all information you provide is accurate, current and complete, and that you have the legal right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must not transfer, assign, sell or license your account to any other person.

We aim to provide accurate product descriptions and images. However, colours, finishes and product appearance may differ depending on your device, settings or lighting. We do not guarantee that products will match their online depiction exactly.
All product descriptions, pricing, availability and specifications may be changed or discontinued at any time, without notice and at our sole discretion. We may also limit product quantities on a per-person, per-household, per-order or per-region basis.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason. Your order is not confirmed until payment has been processed and you receive an order confirmation email.
Please review your order carefully before submitting it, as we may be unable to modify or cancel an order once it has been accepted.
All purchases are subject to our Refund Policy.
You represent that purchases are for personal or household use only and not for resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions may change at any time without notice. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation. Unless otherwise stated, prices exclude taxes, shipping, handling, customs duties and import fees.
Prices online may differ from prices offered in physical stores or by third-party retailers. Promotional offers may be governed by separate terms. If those terms conflict with these Terms, the promotional terms will apply.
Only one discount code or promotional offer may be used per transaction, unless explicitly stated otherwise.
You agree to provide accurate and up-to-date billing information, including credit card details and contact information, and to promptly update these details when they change.
You confirm that:
(i) the payment information you provide is valid and complete
(ii) you are authorised to use the nominated payment method
(iii) all charges will be honoured by your payment provider
(iv) you will pay all applicable charges, including taxes, shipping and handling.
SECTION 5 – SHIPPING AND DELIVERY
All delivery timeframes are estimates only. We are not responsible for delays caused by carriers, customs, weather, peak periods or events beyond our control.
Risk of loss and title pass to you once your order is handed to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All trademarks, logos, text, graphics, images, product content, video, audio and other material available through the Services are owned by Lanotec, its affiliates or licensors, and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You must not copy, reproduce, distribute, publish, modify, create derivative works of, publicly display or exploit any content without our prior written consent.
Shopify trademarks, logos and brand elements belong to Shopify. All other trademarks are the property of their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to tools and features operated by third parties. These tools are provided “as is” and “as available” without warranties of any kind. Your use of any third-party tools is entirely at your own risk and subject to the third-party’s terms.
Future features or tools added to the Services will also be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
Our Services may include links to third-party websites or materials. We are not responsible for examining or evaluating their content or accuracy, and we assume no liability for your access or use of them.
Please review third-party terms and policies before engaging in any transaction. Any disputes regarding third-party products or services should be directed to that party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Lanotec is powered by Shopify, but all purchases are made directly with Lanotec. Shopify is not responsible for any injuries, losses, damages or claims arising from your transactions with us. You expressly release Shopify from such claims.
SECTION 10 – PRIVACY POLICY
All personal information collected through the Services is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy. Because Shopify hosts the Services, your information may be transferred, stored and processed in countries other than your own.

SECTION 11 – FEEDBACK
By submitting any ideas, suggestions, reviews, comments or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and distribute that Feedback for any purpose.
You warrant that you own or have rights to the Feedback you provide, that it does not violate any third-party rights, and that you have disclosed any compensation received for submitting it.

Sections intended to survive termination will continue to apply.

The Services and all products are provided “as is” and “as available” without warranties of any kind, unless expressly stated otherwise. We do not warrant uninterrupted, secure or error-free use of the Services.

To the fullest extent permitted by law, Lanotec and its officers, employees, partners, contractors, agents and affiliates will not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of revenue, data or profits, arising from your use of the Services or products purchased.

You agree to indemnify and hold harmless Lanotec, Shopify, and their partners, employees, officers and agents from any claims, damages or expenses arising from your breach of these Terms or your misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right does not constitute a waiver. These Terms and any posted policies form the entire agreement between you and Lanotec.
SECTION 20 – ASSIGNMENT
You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights without notice.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia. You consent to the jurisdiction of courts located in Queensland.
SECTION 22 – HEADINGS
Headings are provided for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS OF SERVICE
We may update these Terms at any time by posting the revised version. Your continued use of the Services after changes are posted constitutes acceptance of those changes. We will notify you of material changes where required by law.
